Update: 1/13/2010: Before this bill was passed and signed into law in 2009, Persons who held open carry permits issued by rural County Sheriffs could arguably open carry loaded handguns throughout California with immunity to Cal. Penal Code Sections 12031 (load ban in public areas of incorporated areas as well as public areas of unincorporated areas where the County has banned all shooting) and 626.9 (school zone gun carry ban). AB 1363 Clarifies that open carry permit holders are only immune from Cal. Penal Code Sections 12031 and 626.9 in the County where the open carry permit was issued.
It's very important for California gun owners to know that, except for school zones, they can still openly carry loaded handguns (without any license) in non-public areas of California, see People v. Strider , and in all areas of unincorporated areas where the County has not banned all shooting, see People v Knight , and that this includes the right to open carry loaded guns in vehicles on public roads in unincorporated areas except where the County has banned shooting, see People v. Segura (unpublished but available on Lexis & Westlaw).
